Child Pornography
Sexual Assault Defense Attorney
How you can be charged
Child Pornography is the possession of sexually explicit material involving children. These cases involve expert eyewitnesses, computer experts, internet experts, etc. This is a Class C felony and can be punished with 3 to 10 years in prison and/or a fine of up to $10,000.
Any Arkansas sex crimes attorney will tell you that you must “knowingly” possess child pornography to be charged with the possession of it, but the material does not have to actually be in someone’s possession. It’s completely possible to be deemed in possession of child pornography that is in the unallocated (deleted) space of your computer or hard drive.
